			<content:encoded><![CDATA[<p>Recent research by RealtyTrac Year-End 2009 Foreclosure Market Report reveals that 3,957,643 foreclosure filings were reported on 2,824,674 U.S. properties in 2009. This includes scheduled foreclosure auctions, default notices and bank repossessions.</p>
<p>This is a twenty one percent increase in land from statistics in data that was collected in 2008, and a one hundred and twenty percent increase in total properties from 2007. Additionally the report indicated that one in forty five housing units, 2.21 percent, got at least one foreclosure filing in the year of 2009, up from 2008&#8217;s 1.48 percent and 2007&#8217;s 1.03 percent.</p>
<p>In the month of just December, foreclosure filings measured out to 349,519 properties in December. This marks a fourteen percent jump from the last month of November and a fifteen percent increase from 2008. However, even though there was an increase in December, foreclosure activity in the fourth quarter of 2008 has decreased by seven percent.</p>
<p>Of all of the states, Nevada claimed the nation&#8217;s highest state foreclosure rate; more than ten percent of housing units received at least one foreclosure filing in 2009. That makes Nevada&#8217;s third consecutive year at the top of the foreclosure list. Nevada&#8217;s foreclosure activity in December increased twenty seven percent from the previous month, but still was down by twenty two percent from December of 08.</p>
<p>Arizona claimed the country&#8217;s second highest state foreclosure rate in 2009 with even more than six percent of properties that received at least one foreclosure filing during 2009, and Florida was the country&#8217;s third highest foreclosure rate at 5.93 percent of its properties getting at least one foreclosure during the filing year.</p>
<p>This raises issues in the collection&#8217;s industry. Recent trends have told collections officials that consumers are purposely pumping up their credit debt and downplaying their assets to get lower payment plans. The fact that they are increasing debt on their credit cards to receive lower payment plans does not look promising.</p>

			<content:encoded><![CDATA[<p>In a mind-blowing turn of events, bill collectors from Advanced Call Center Technologies LLC have to shell out a whopping one point five million dollars for rude and vulgar voicemails that were sent to a man&#8217;s mobile phone. According to sources, the company sent out eight threatening and demeaning voice mails on Allen Jones&#8217; phone attempting to collect what it claimed he owed on a credit card.</p>
<p>Most of the messages were ridden with profanity and horrifying racial slurs. &#8220;This is your mother (curse) wakeup call you little lazy (curse) (curse),&#8221; a collector was quoted as saying in one message. &#8220;Get your (racial slur) (curse) up and go pick some mother (curse) cotton fields,&#8221; said another. Jones is African-American.&#8221;This is not acceptable. Nobody should have to go through what I had to go through,&#8221; he said.</p>
<p>Mark Frenkel, one of Jones&#8221; lawyers says: &#8220;If we didn&#8217;t have the messages on tape, nobody would have ever believed that this occurred.&#8221; &#8220;This is definitely, without any doubt, the most horrifying collection case I have ever seen,&#8221; Dean Malone, Jones&#8221; other lawyer, added. Jones took Advanced Call Center Technologies to court over the harassing, threatening phone calls. And last Friday, a Dallas County jury awarded him of the biggest verdicts of its kind &#8211; 50,000 dollars in mental anguish and one point five million dollars in punitive damages.</p>
<p>&#8220;Today we made a statement&#8221; said Jones in reply to the verdict, &#8220;and the statement is we will not tolerate abusive debt collectors.&#8221; According to the attorneys, employees from Advanced Call Center Technologies confessed to the calls, but it remains unclear if they are still with the company and whether the company will appeal the case or not.</p>
<p>Meanwhile, Jones has always disputed the debt and claims that he paid it, and the amount in question was a minuscule amount of two hundred dollars. It seems unbelievable that this man had to suffer like this for such a small amount, and now, thanks to the American court system, and justice, it is.</p>

<p>According to bankruptcy attorneys not only is it firings and layoffs that are motivation to file. It&#8217;s the loss of once-regular over time pay and full time status that have left people unable to keep up with monthly payments that are once were not an issue to pay.</p>
<p>U.S. Bankruptcy Court records shows us that there were 27,413 bankruptcy petitions filed in Wisconsin last year. More than 80% were Chapter 7 cases. Chapter 7 cases wipe out medical bills, credit card balances, and other kinds of debt. Recent Research by The Associated Press illustrated that more than 1.4 million bankruptcies were filed in 2009. That&#8217;s an increase of about 32% from 2008.</p>
<p>And even though bankruptcy absolved the impending debt and offers consumers a fresh financial start, people often stay unemployed and are unable to find employment to get a decent income agency.</p>
<p>To add to the bad news, unless the economy recovers enough for industries to start hiring again, there is not much reason to think that bankruptcies will decrease in 2010. Researchers have predict that home foreclosures will continue to pile up in 2010 because people who previously had adequate credit have lost employment and ccan&#8217;tkeep up with payments.</p>
<p>Bankruptcy could seem like a good option to get a fresh start, but it has a negative effect on your credit report for ten years, leaving you unable to get a car, place of residence, or employment. Before declaring bankruptcy, it might be a wise decision to speak with your creditors and see if some sort of repayment plan can be worked out.</p>
